பயங்கரவாத சட்டங்கள் விடயத்தில் ஜனாதிபதி மக்கள் ஆணையை மீறுகிறது – NSC

தற்போதுள்ள பயங்கரவாதத் தடுப்புச் சட்டத்தை ரத்து செய்வதைத் தவிர, புதிய பயங்கரவாத எதிர்ப்புச் சட்டம் ஒன்றைப் பிறப்பிக்க ஆளும் தேசிய மக்கள் சக்தி அரசாங்கத்திற்கு எந்தவித மக்கள் ஆணையும் கிடையாது என தேசிய ஷூரா சபை சுட்டிக்காட்டியுள்ளது.

அச்சட்டம் ‘கறுப்பு ஜூலை’ என்ற நாடளாவிய தமிழர்கள் இனப்படுகொலைகளுக்கு வழிவகுத்து, அதன் எதிர்வினையாக வெடித்த பிரிவினைவாத யுத்தம் 33 ஆண்டுகள் நீடித்து நாட்டில் பொருளாதாரப் பேரழிவை ஏற்படுத்தியுள்ளது!

கடந்த தசாப்தங்களில் நாம் கண்ட ஒரு உண்மை யாதெனில், என்ன பெயரில் வந்தாலும் பயங்கரவாதச் சட்டங்கள் சிறுபான்மையினரை ஒடுக்கவே பயன்படுத்தப்பட்டன என்பதாகும்!

அது தவிர இன்று நாட்டில் எங்குமே பயங்கரவாத அச்சுறுத்தல் கிடையாது!

இந்நிலைமையில் புதிய பயங்கரவாத எதிர்ப்புச் சட்டங்கள் பற்றி அரசாங்கமே பேசுவது சர்வதே சமூகத்தின் மத்தியில் ஒருவித பீதியை உருவாக்கி, பெரியளவில் முன்னேற்றம் கண்டுவரும் சுற்றுலாப் பயணிகளின் வருகையையும்,வெளிநாட்டு முதலீடுகளையும் மற்றும் பொருளாதார மறுசீரமைப்பையும் பாதிப்பது நிச்சயம்!

அது மட்டுமல்லாமல் ஜனாதிபதி தேர்தல் மற்றும் பாராளுமன்றத் தேர்தலுக்கு முன் தாம் ஆட்சிக்கு வந்தால் பயங்கரவாதத் தடுப்புச் சட்டத்தை ஒழிப்பதாகவே ஜனாதிபதி அனுர குமார திசாநாயக்கவும் அவரது அரசும் வாக்குறுதியளித்தது. அவ்வாறு செய்வதற்கே மக்கள் ஆணையை வழங்கினார்கள். மாறாக, புதிய பயங்கரவாதச் சட்டங்களைக் கொண்டுவர மக்கள் ஆணை வழங்கவில்லை என்பதையும் தேசிய ஷூரா சபை நினைவூட்ட விரும்புகிறது.

இது தொடர்பாக தேசிய ஷூரா சபை ஜனாதிபதி அனுர குமார திசாநாயக்க அவர்களுக்கு ஒரு கடிதத்தை அனுப்பியுள்ளதுடன், அதில் கடந்த 25 ஆண்டுகளில் நிறைவேற்று அதிகாரம் மற்றும் காவல்துறையின் விரிவான அதிகாரங்கள் கிடைக்குமாறு போதுமான பல்வேறு சட்டங்கள் ஏற்கனவே இயற்றப்பட்டுள்ளமை பற்றியும் சுட்டிக்காட்டப்பட்டுள்ளது. பயங்கரவாதம் முற்றிலுமாக அழிக்கப்பட்டு பதினாறு ஆண்டுகள் கடந்து, தற்போது இங்கு எந்தவித பிரிவினைவாதிகளோ பயங்கரவாதிகளோ இல்லாமல் நாடு சுமுகமாகச் செயற்பட்டு வரும் நிலையில், பயங்கரவாதத் தடுப்பு தொடர்பான புதிய சட்டங்களுக்கு எந்த அவசியமும் கிடையாது எனவும் தேசிய ஷூரா சபை அக்கடிதத்தில் குறிப்பிட்டுள்ளது.

ஜனாதிபதிக்கு தேசிய ஷூரா சபை எழுதிய கடிதத்தின் முழு வடிவம் பின்வருமாறு:

தேசிய ஷூரா சபை (NSC)  தேசிய அளவிலான முஸ்லிம்  சமூக அமைப்புக்களை உள்ளடக்கிய பொது சிவில் அமைப்பாகும். இது பிரபல சமூக ஆளுமைகளையும் உள்ளடக்கியதாக அமைகின்றது. 2012 ஆம் ஆண்டு முதல் முஸ்லிம் சமூகத்தின் மீது கட்டவிழ்க்கப்பட்டு நாட்டின் பல இடங்களில் முஸ்லிம் மக்களுக்கு எதிரான வன்முறைகள் தொடரப்படுவதற்கு வழிவகுத்த முஸ்லிம் விரோத செயற்பாடுகளின் பின்னணியில், 2013 ஆம் ஆண்டு இந்த அமைப்பு நிறுவப்பட்டது.

தேசிய மக்கள் சக்தி (NPP) தனது சமீபத்திய ஜனாதிபதி மற்றும் பொதுத் தேர்தல் விஞ்ஞாபனத்தில் பயங்கரவாதத் தடுப்புச் சட்டம்  (PTA) வை இரத்து செய்யும் என தெளிவாகவே வாக்குறுதியளித்துள்ளது. ஆனால் பயங்கரவாத தடுப்புச் சட்டத்துக்கு பதிலாக வேறொரு சட்டம் கொண்டு வரப்படும் என  தேர்தல் விஞ்ஞாபனத்திலோ பிரச்சாரங்களிலோ அறிக்கைகளிலோ தெரிவிக்கப்படவில்லை. ‘பயங்கரவாதத் தடுப்புச் சட்டத்தை இரத்துச் செய்வது’ என்பது தான் வாக்குறுதியாய் அமைந்ததே ஒழிய ‘அதற்குப் பதிலாக புதிய சட்டம் கொண்டு வருவது’ என்று எங்கேயும் குறிப்பிடப்படவில்லை!

1979 இல் பயங்கரவாதத் தடுப்புச் சட்டம் இயற்றப்பட்டதிலிருந்து, தமக்குரிய நிறைவேற்று அதிகாரத்தை பயன்படுத்தி அப்போதைய ஆட்சியாளர்ககள் இந்தச் சட்டத்தை தவறாகப் பயன்படுத்தினார்கள். இதுவே 1983 ஆம் ஆண்டு தமிழர் விரோதக் கலவரம் உட்பட தீவிரவாதத்தின் வளர்ச்சிக்கு அமைந்த காரணங்களுள் ஒன்றாக  அமைந்தது. பயங்கரவாதத் தடுப்புச் சட்டம் வன்முறையை ஒழிக்கவில்லை; மாறாக தீவிரவாதத்தைப் பெருக்கி, நாட்டை 30 ஆண்டுகளுக்கு மேற்பட்ட காலம் நீண்ட போர் ஒன்றில் தள்ளியது. இது நாட்டை பொருளாதார ரீதியாக சீரழித்ததுடன் ஆயுத உற்பத்தி நாடுகளுக்கு பெரும் வருமானத்தை ஈட்டிக் கொடுத்தது.

2009 மே மாதம் யுத்தம் முடிவடைந்ததன் பின்னர் பயங்கரவாத தடுப்புச் சட்டமானது முஸ்லிம்கள் மற்றும் கிறிஸ்தவர்களுக்கு எதிராக உருவான வெறுப்புப் பிரச்சாரங்களைக் கட்டுப்படுத்த பயன்படுத்தப்படவில்லை. 2014 ஆம் ஆண்டு முதல் முஸ்லிம் சமூகத்தின் மீதான தாக்குதல்கள் தொடர்ந்த வண்ணம் இருந்த்தன. 2018ம் ஆண்டில் மட்டும் 25க்கும் மேற்பட்ட பள்ளிவாசல்கள் தாக்கப்பட்டன. 21.04.2019ல் இடம்பெற்ற ஈஸ்டர் தாக்குதல்களைத் தொடர்ந்து நியமிக்கப்பட்ட பாராளுமன்ற தெரிவுக்குழுவும் ஜனாதிபதி ஆணைக்குழுவும் ஏழு பெரும்பான்மைவாத தீவிரவாத அமைப்புகளின் நடவடிக்கைகளும் ஈஸ்டர் தாக்குதலுக்கு காரணமாக அமைந்தமையை சுட்டிக்காட்டின.

இத்தகைய வரலாற்றுப் பின்னணியில், நாம் தேசிய மக்கள் சக்தியிடம் அதன் வாக்குறுதியை மதித்து பயங்கரவாத தடுப்புச் சட்டத்தை இரத்து செய்யுமாறும், அச்சட்டத்துக்குப் பதிலாக வேறு எந்த சட்டத்தையும் கொண்டுவர வேண்டாம் என்றும் கேட்டுக்கொள்கிறோம். கடந்த 25 ஆண்டுகளுக்குள்ளால் ஏற்கனவே பல தடவைகள் புதிய பல்வேறு பாதுகாப்புச் சட்டங்கள் நிறைவேற்றப்பட்டுள்ளன. இச்சட்டங்கள் நிர்வாக அதிகாரிகளுக்கும் காவல்துறைக்கும் பரந்த அதிகாரங்களை வழங்கியுள்ளதால் புதிய பயங்கரவாத எதிர்ப்பு சட்டம் உருவாக்குவது தேவையற்றது என்பதனை வலியுருத்துகிறோம்

இலங்கையில் பயங்கரவாதம் ஒழிக்கப்பட்டு 16 ஆண்டுகள் நிறைவடைந்துள்ளன. தற்போது தீவிரவாதத்திற்கான எந்த ஆபத்தும் இல்லாத. நிலையில் பயங்கரவாதத் தடுப்புச் சட்டம் தொடர்ந்தும் நடைமுறையில் இருப்பதானது எமது நாட்டைப் பற்றிய  ஒரு எதிர்மறையான அபிப்பிராயத்தை உலகளவில் ஏற்படுத்தும். அதன் விளைவாக

சுற்றுலாத் துறை, வெளிநாட்டு முதலீடுகள், மற்றும் பொருளாதார முன்னேற்றங்கள் பாதிப்படையும் என நம்புகிறோம்.

பயங்கரவாதத் தடுப்புச் சட்டத்தின் கொடூரமான அம்சங்களை மாறுபட்ட பெயரில் மீண்டும் கொண்டுவர சில வெளிநாட்டு தரப்புகள் அழுத்தம் கொடுக்கின்றன. இதன் நோக்கம், இலங்கை இன்னும் தீவிரவாத ஆபத்துக்குட்பட்டதாகவே இருக்கிறது என்ற பிம்பத்தை உருவாக்கி, நாட்டின் பொருளாதார மேம்பாட்டை தடுப்பதாகவும், இந்து சமுத்திரத்தில் நிலவும் பலம் பொருந்திய நாடுகளுக்கிடையிலான மோதல்களில் இலங்கையை அடிமைத்தனமான நிலைக்கு கொண்டு செல்வதாகவும் இருக்கலாம்!

பயங்கரவாதத் தடுப்புச் சட்டத்துக்குப் பதிலாக புதிய சட்டமொன்றை உருவாக்கும் நோக்குடன் நீதி மற்றும் தேசிய ஒருமைப்பாடு அமைச்சர் நியமித்துள்ள குழுவில் 90% அதிகமானவர்களாக  அரச அதிகாரிககள் நியமிக்கப்பட்டமை ஏமாற்றம் அளிக்கின்றதாக உள்ளது. இது அரசியலமைப்பின் சுயாதீனத்துகும், நீதிக்கும், தேசிய ஒருமைப்பாடுக்கும் முரணானதொரு விடயமாகும். இக்குழுவில் சுயாதீனமான, பல்துறைகளை பிரதிநிதித்துவம் செய்யும் உறுப்பினர்களுள் ஒரு முஸ்லிம் உறுப்பினரும்  இல்லாமை ஏமாற்றம் தருவதாக உள்ளது.

NSC tells President, ruling party has no mandate to enact a new Anti-Terror Law except to repeal the present terror act!

PTA also led to the 1983 anti-Tamil racial riots and the 33-year costly war, which bankrupted the country!

Terror laws were used only against the minorities!

Today, there is no terrorism anywhere in the country!

New anti-terror law will send a negative image and discourage tourism, investments and economic recovery!

The National Shoora Council (NSC) has urged President Anura Kumara Dissanayake to honour the election pledge and repeal the Prevention of Terrorism (Temporary Provisions) Act (PTA) without replacing it with a new Anti -Terrorism law, as no such mandate was sought from the people in the ruling partys manifesto.

The NSC has also pointed out in its letter to President Dissanayake that over a dozen new laws had been enacted during the last 25 years with wider powers being vested in the executive and the police. The Muslim civil society has also said that sixteen years have elapsed since terrorism was wiped out and that today there is no sign of any terrorism in the country.

The following is the full text of the NSC letter to the President:

The National Shoora Council (NSC) is a consultative body of premier Muslim organisations in Sri Lanka with a national reach and includes citizens of repute. The NSC was established in 2013 following a series of Islamophobic attacks on the Muslim community from 2012 onwards and which led to several devastating anti-Muslim riots in the country.

The National Peoples Power (NPP) pledged in its recent presidential and general election manifestos to repeal the PTA unequivocally, but it did not declare in the manifesto or in its election campaigns that any other new law would replace the PTA! If the pledge were to replace the PTA with another law, the NPP would have said so clearly. Repeal of PTA was the pledge, while replacement of the PTA was never even talked about or placed before the people!

You are well aware that the abuse of the PTA by the countys then executive from 1979 onwards contributed significantly to the 1983 anti-Tamil riots as well as to the growth of violence and terrorism in the island nation. Sri Lanka got pushed into a costly war that lasted for over thirty years. The PTA instead of eliminating violence, multiplied terrorism and economically bankrupted the nation while enriching the arms-producing countries.

You are also no doubt aware that after the war ended in May 2009, the PTA was not used to restrain the majoritarian hate campaigns that were unleashed from 2012 onwards, initially against

the Christians and soon thereafter on the Muslims. The Muslim community endured several violent attacks on their businesses, Mosques, and homes from 2014 onwards. Over 25 Mosques were

attacked in 2018 alone, months before the Easter attacks. The Parliamentary Select Committee and the Presidential Commission on Easter attacks blamed the actions of seven majoritarian extremist organisations as also having led to the Easter attacks of 21/04/2019.

The point we make is that the then executive abused the PTA, directing it only against the minorities, particularly against the patriotic Muslim community of Sri Lanka, who stood against the division of the country, opposed LTTE terrorism and were soon ejected from the North by the LTTE whilst thousands in the East were killed and their lands grabbed.

It is in this context that we urge the NPP to honour its promise to the nation to repeal the PTA and not to replace the PTA by another law, as there are over a dozen new laws enacted within the last twenty-five years with wide powers vested in the executive and the police. It is 16 years since terrorism in Sri Lanka was wiped out. There is no sign of terrorism anymore. The Anti-Terrorism

Bill will send a negative message and image of Sri Lanka worldwide. It will discourage tourism, investments, and economic recovery!
We urge the NPP not to fall into external traps that seek to replace PTAs draconian provisions with a new Anti-Terror Law as indeed today there is not the slightest threat of terrorism anywhere in the country. The objectives of these external elements appear to be to propagate to the world that Sri Lanka is still a country subject to terrorism, debilitating its economic resurgence, and keeping Sri Lanka subservient to powerful nations to better facilitate forthcoming regional conflicts in the Indian Ocean!

The Anti-Terrorism Bill Committee, appointed by the Hon. Minister of Justice and National Integration to draft a non-mandated replacement to the PTA, is packed regrettably with 90% government officials and does not have a diversity of independent members reflecting the spirit of the Constitution, justice, or national integration!
